SIC What is the School Improvement Council?
The School Improvement Council serves as an advisory committee to the school principal and faculty. The council works with the school to develop and implement a five-year school improvement plan, monitors and evaluates success in reaching the plan's goals and objectives, and writes an annual report to parents about the progress of the plan.
Who may serve on a council?
Almost anyone is eligible to serve on a SIC – parents, teachers, business partners, community members.
Why should parents and citizens become involved?
When parents are involved in their children’s education, children go to better schools and children do better in school. Parents can bring great wisdom to the deliberations of a council if they are truly a part of the decision making process. Your participation provides the school and school district with much needed support from a knowledgeable group who will advocate for their school’s benefit. School Improvement Council meetings are held on the first Monday of each month.
GENERAL INFORMATION
ARRIVAL: Car riders and walkers are to arrive no earlier than 7:15a.m. Car riders are to be dropped off at the 4K wing entrance. Car riders eating breakfast must be at school by 7:30 a.m.
TARDINESS/EARLY DISMISSAL
Uninterrupted class time is extremely important to the learning of all students. Therefore, Saluda County Schools have adopted new procedures for the upcoming school year.
All students arriving to school after 8:00 a.m. must report to the office with an adult for an admission slip to class. A student will be allowed to be tardy (unexcused) three times with no consequences. On the fourth and all subsequent tardies, students will be assigned to after school detention the following day. Detention will not be held on Friday. Parents/ Guardians will need to pick up students from detention at 3:45 p.m.
As students being tardy pose a problem for our instructional day, so do early dismissals. Students will be allowed to be signed out early with no written appointment card three times. On the fourth and all subsequent early dismissals, students will be assigned to after school detention the following day. Detention will not be held on Friday. Parents/ Guardians will be responsible for picking up students from after school detention at 3:45 p.m.
Habitual violators will be addressed with additional consequences. Thank you for working with us to provide an uninterrupted school day for all students!
DISMISSAL: Students riding the bus routes are loaded at the front entrance at 2:50p.m. Car riders are to be picked up at 2:50p.m. Students are to leave the school campus immediately after school unless detained by a teacher or principal. Parents are to pick up children on time. Students will remain in the loading area until traffic has cleared. At this point, students will be taken to the Saluda Primary Office, and the parent must sign out the child in the office.
No student is allowed to leave school during the day unless a parent or parent designee comes for him/her. If someone other than a parent or legal guardian is to pick up the student for early dismissal, the parent or guardian must send a note to school stating who has permission to sign out the student from school. Parents must sign students back IN if returning on the same day.
ANY and ALL changes in normal transportation must be in WRITING prior to 2:00 of the school day. THIS WILL BE STRICTLY ENFORCED
ABSENCES: A written excuse is required when a student is absent from school. The excuse is to be sent to the attendance secretary and will be kept on file along with the attendance record. If your child is absent four consecutive days you must have a medical excuse or it will be considered an unlawful absence. Lawful absences include illness, serious illness or death in the immediate family, and recognized religious holidays. All other absences are normally not excusable. No child who has chronic absences, can receive an adequate education. We urge you to make sure your child is in school every day.
AFTER THREE CONSECUTIVE ABSENCES OR A TOTAL OF THREE ABSENCES – THE FOLLOWING WILL OCCUR
§ The parent/legal guardian will be notified of the absences by the truancy officer or attendance dept.
§ The school representative will conduct phone conference to discuss the attendance policy and to determine attendance requirements for the remainder of the year
AFTER A TOTAL OF FIVE ABSENCES – THE FOLLOWING WILL OCCUR
§ The parent/guardian will be notified of the absences and a copy of the attendance letter and record will be mailed to the parent/guardian
§ A conference will be scheduled with the parent/guardian, student and the counselor to place the student on an attendance improvement plan.
AFTER A TOTAL OF SEVEN ABSENCES – THE FOLLOWING WILL OCCUR
§ A school official will make parent contact to review the attendance improvement plan with the parent/guardian and student.
§ The parent/guardian will be notified that further absences may warrant the filing of a truancy petition with DSS by the district office.
Make-up work
Students who have lawful absences will be allowed to make up work missed. The student must make up the work within three school days after their return to school. This does not include work previously assigned. *Teachers must provide students with the make-up work as needed whether before school, after school or at a mutually convenient time during the day. Students who have unlawful absences will not be permitted to make up work missed. *If a student has missed several consecutive days, additional time for make-up will be provided.
HOMEBOUND: Students who exceed the allowable absence limit will not receive credit or will not be promoted unless the student is or has been enrolled in the district’s homebound instruction program. Homebound instruction cannot be activated for fewer than five consecutive absences.
TRUANCY: Truancy is an unlawful absence and will not be tolerated. Students who are absent without parental knowledge or with parental knowledge but for unacceptable reasons will be subject to appropriate disciplinary action, including referral to family court.
· Students with excessive unlawful absences will be referred to family court. Unlawful absences accrue both under the specific definitions in this policy and also when a student exceeds the absence limits for receiving credit or promotion without a medical excuse.
· Students must bring written excuses from parents/legal guardians or a health practitioner for all absences. Excuses must be provided to the school within three days of the student’s return to school.
EMERGENCY SCHOOL CLOSING: When inclement weather occurs, district administrators will decide as soon as possible if school will be open. The decision will be aired on the following stations, WJRQ Saluda, WBLR Batesburg, WJES Johnston, WCRS Greenwood, WJDK Newberry, and WIS Columbia. You will also be contacted by our automated phone/email/text system called ALERT NOW.
HANDBOOK AMENDMENT: The handbook may be amended as deemed necessary by the administration and staff in the best interest of the students. Any changes will be provided in oral and/or written form.
TRAFFIC AND PARKING: For the safety of the students, please drive slowly and courteously. Traffic violators will be reported to the local police if student safety is jeopardized. If you need to visit the school, park in front of the school. You may park in front of the school only between the hours listed on the sign. The staff/visitor parking lot located by the district office may be used at other times.
CAR RIDERS: Parents who bring their children to school and pick them up should follow these directions. All cars should enter from North Wise Road to Matthews Road, then drive between the two campuses. Stay to the right and go through the area that is used for parking. Exit this area to make a loop to go back out to North Wise Road. A drop off/pick up area will right outside the covered area. Students are not to be dropped off at any other area of the school.
BUSES:
The school transportation system is owned and financed by the State. Bus drivers are carefully screened and given bus training for their job. A few rules in regard to buses are as follows:
· Parents must sign children out in the front office before they get on the bus, once on the bus, the child cannot get off until the bus reaches the designated stop.
· The school bus is considered a classroom – no smoking, no eating or drinking, no paper throwing, and no getting up and moving about.
· Students should be at the bus stop in the morning ready to board. The bus will not wait for you. Exceptions are made during inclement weather.
· Students are to ride only the bus to which they have been assigned. Students must have written permission from a parent in order to ride a different bus. This note must be approved by the principal or designee.
· Students will not be allowed to carry balloons or flowers in glass vases on the bus.
· Students will not be allowed to transport animals on the school bus
· Remember riding the school bus is a privilege, not a right. We must follow all rules.
WITHDRAWING FROM SCHOOL: If a student is moving and is withdrawing from school, please come by the school guidance office a few days before the withdrawal date. This will give ample time to complete the necessary paperwork. Your cooperation is always appreciated.
DRESS CODE: Students must dress appropriately for school. Learning is maximized in an environment that is free from distracting elements and influences. Our main concern is that students participate and learn without fear of ridicule, without comments about their clothing, or without embarrassment caused by the dress of another student. Inappropriate language or gestures printed on clothing is not acceptable. It is expected that children come to school clean, neat and well groomed. The administration will make final judgment on the appropriateness of dress and reserves the right to prohibit students from wearing any articles of clothing or accessory which may create discipline problems.
--Shorts – mid thigh or longer
--Shirts – no bare mid-drifts or tank tops
--Pants – worn at natural waistline, no visible undergarments
--Shoes – soled shoes (FLIP FLOPS not appropriate for student play)
--Hats – not permitted in the building
--Content – inappropriate advertising and/or slogans not permitted
PLEDGE: Each day during morning announcements students will say the Pledge of Allegiance and Saluda Primary pledge. If a parent objects to his/her child reciting the Pledge of Allegiance, that parent must provide a written statement to exclude their child from this activity. All children will be asked to stand to show respect.
LOST AND FOUND: Please label all personal belongings. Lost items cannot be returned if the school can not determine rightful ownership. The lost and found area is located in the nurse’s office. Every nine weeks lost and found items not picked up will be donated to charity.
CELEBRATIONS: During the school year, class celebrations are limited to one first semester and one second semester. These celebrations are limited to the last hour of the school day. The presence of younger, non-school age children is discouraged. Birthday parties are not appropriate at school. Parents may wish to send one item per child treat for the class to enjoy at recess or lunch in honor of their child. Please advise the teacher ahead of time, if you plan to send a treat. Parents may send party invitations to be distributed at school, if every student in the class receives one. If you have a question about this policy, please contact the school office for further clarification.
BALLOON AND FLOWER BOUQUETS: If you have flowers to be delivered, please follow the procedures as outline below:

· BALLOONS AND FLOWERS IN A GLASS VASE MUST BE PICKED UP AT SCHOOL. BALLOONS OR GLASS ITEMS WILL NOT BE ALLOWED ON THE BUSES!!
VALUABLES: Please send only necessary money to school with your child. Please put the money in an envelope and mark on the envelope exactly what the money is for. OTHER MONEY, TOYS, ATHLETIC EQUIPMENT, ELECTRONIC GAMES, TAPE PLAYERS AND EXPENSIVE ITEMS SHOULD BE LEFT AT HOME. The school cannot be responsible for damage to, or loss of, such items.
General Rule: “If they don’t need it, they should not have it”
PARENT/TEACHER CONFERENCES: The school calendar has a built in parent/conference date: October 29, 2010. It is necessary for teachers to devote their full attention to pupil instruction. THEREFORE, ALL CONFERENCES MUST BE HELD AFTER SCHOOL OR WHEN TEACHERS ARE NOT SUPERVISING STUDENTS. We ask that you call the school office or communicate in writing with the teacher through your child’s agenda book to arrange conferences. Requests for conferences during regular student hours cannot be granted unless the teacher is not directly supervising students.
COUNSELOR: Students and parents are encouraged to make an appointment to discuss matters of concern with the guidance counselor. In addition to individual conferences, guidance classes will be provided at each grade level throughout the school year.
VANDALISM: Willful and intentional damage to any school property will be subject to severe consequences. Parents/guardians will be responsible for reimbursement of damages.
FIRE/DISASTER DRILLS: Drills are necessary for the safety of the students, staff, and faculty. Everyone should know the specific directions for reaching a point of safety from those areas of the school building in which he/she may be. The escape plan for fire drills is posted in each room.
SUPPLIES: Basic instructional materials are provided for the student. Each student is expected to come to school equipped with pencils and paper. Occasionally, parents are asked to donate food items, materials, or money for students to enjoy a special activity. No student will be denied the right to participate based on the inability to contribute.
SCHOOL STORE: The school store is open 2 days a week from 7:15a.m. - 7:45a.m. Students may purchase pencils, paper, erasers, crayons, and misc. school items.
TEXTBOOKS: Textbooks and workbooks are issued to students free of charge. Once issued, the materials become the responsibility of the student and parents to insure that the materials do not become lost or damaged beyond normal usage. Loss or excessive damage to textbooks will result in the student being fined.
IMMUNIZATION/HEALTH/BIRTH CERTIFICATE/SOCIAL SECURITY CARD: State law requires all students to have adequate immunization, health (eye, ear, dental) examinations, and birth certificates. Beginning with the 1997-1998 school year, all children born after January 1, 1992 are required to have proof of the Hepatitis B vaccination. Health and immunization records may be obtained at the Saluda County Health Department. A copy of the social security card and birth certificate is needed for school records. Immunizations must be current for students to attend school.
LICE/RINGWORM: Any child found with lice, nits or ringworm will be sent home immediately. Before returning to school, the parent must receive a certificate from the health department or personal physician stating that the student has been treated and is completely free of lice, nits or ringworm or must bring proof of use such as labels of shampoo. The student must be checked by the school nurse or office staff before he/she can return to the classroom.
SCHOOL VISITATION: There will be many opportunities for you to participate in your child’s education. Volunteers are greatly appreciated at Saluda Primary. For example, parents can volunteer as guest speakers, tutors, field trip chaperones, or room representatives. If you are interested, please contact the teacher, school office, or the PTA. Everyone is welcome in our school.
A few guidelines:
1. All visitors must check in at the office to obtain and wear a visitor’s sticker. Anyone who is not wearing a visitor’s sticker will be questioned.
2. Appointments are preferred. Parents are invited to enjoy eating breakfast and lunch with their children. Lunch schedules will be sent home at the beginning of the year.
3. If visitation of adults presents an instructional disruption, parents may be asked to leave.
Procedures for classroom visits are as follows:
● Must be approved by principal
· Sign-in at the office and get a visitor pass.
· Parents will be escorted to classrooms.
· A class visit is not a time for conference with teacher.
· Conferences are encouraged as well.
MEALS: Nutritional meals provided at school are a vital part of the total educational program. We encourage your child to participate in the breakfast and lunch program at school. Prepayment of meals on a weekly or monthly basis is encouraged. Applications for free and reduced price lunches are available to all parents. Applications are available in the office if the family income status changes during the year. Menus are printed monthly. If your child prefers a home-prepared lunch, please have the child bring the lunch to school with him/her in the morning. Delivering outside lunches to students during the school day is discouraged. MEAL FEES: No students may charge more than $5.00. If the charge exceeds $5.00, then the student will receive a sandwich, piece of fresh fruit, and milk until the fee has been paid.
MEDIA CENTER: The Media Center is open to students from 7:35 a.m. - 3:00p.m. All students have a scheduled library period and may come individually with a pass from their teacher. Materials are checked out for a one-week period. A student must return items before checking out additional books. Students are responsible for lost or damaged items checked out in their name and the fee will be charged to the student. All books are to be returned before Christmas vacation, and two weeks before school ends for the year. There are additional resources available to students. The classroom teacher arranges time for student use of these resources. Parents are welcome to use all resources in the media center, and parents are encouraged to come to the media center with their child.
PURCHASE OF NON-CURRICULUM MATERIALS: Because it is so important that students be exposed to literature at an early age, and because children take great pride in owning books, teachers will offer parents an opportunity to purchase materials for use in the home. Book Clubs and Weekly Reader Books are examples of such materials. You are encouraged to take advantage of these opportunities. However, these materials are not part of the classroom instruction and are not required by the school. Twice a year the media center sponsors a book fair. This is an opportunity to purchase materials and books to be used in the home. Parents and students may browse through and purchase a book if desired. The school receives a percentage of the money from the sale of books at the book fairs.
INTERNET: The Internet will be used only by students whose parents have signed a statement of use with adult supervision. NO STUDENT WILL BE ALLOWED TO USE THE INTERNET WITHOUT SUPERVISION. TEACHERS WILL USE THE INTERNET AS DEEMED APPROPRIATE FOR STUDENTS WITHIN THE CLASSROOM FOR INSTRUCTIONAL PURPOSES.
SCHOOL PICTURES: You will have the opportunity to purchase a school picture in the fall and in the spring. Class pictures are taken in the spring. The fall picture is used in the yearbook.
SCHOOL NEWSLETTER: The school newsletter is published monthly. Please watch for important dates and information!
INSTRUCTIONAL PROGRAMS
All students are instructed in reading and language, math, social studies, and science. Students attend related arts classes in music, art, physical education, and the media center on a weekly basis. Students participate in Larson Math, STAR (R & M), and Accelerated Reader. Curriculum and resources are aligned to the South Carolina Curriculum Standards.
HOMEWORK: Homework is an extension of classroom activity and the assignments should be challenging and meaningful. At the discretion of each teacher, homework may be assigned daily. Some of the purposes of homework are:
· To extend the work of the school and to develop good study habits by stimulating voluntary effort, initiative, independence, responsibility, and self-direction.
· To allow the student the opportunity to develop or try his creative ability
· To increase the skills and add to the knowledge of the student
· To encourage a carry-over of worthwhile school activities into permanent leisure interest
· To challenge every student
· To incorporate help and resources of the home and family
REPORTING STUDENT PROGRESS: Teachers will be reporting grades into PowerSchool. A component of this software allows parents to use the internet to access student grades. Progress reports will be issued every 9 weeks. Please sign and return the report the following day. See school calendar for report card dates. Test papers and other work by students will be sent home in the Monday Folder.
SPECIAL EDUCATION: Children with special needs may benefit from several different programs. Resource and self-contained classes are available for students who qualify. Speech & Physical therapy is offered to children who qualify after the screening process. Children who need these special programs must be referred through the Student Assistance Team (SST). This process is headed up by our Guidance Department.
PHYSICAL EDUCATION: All students are required to attend PE classes as part of the instructional program. STUDENTS ARE REQUIRED TO HAVE A DOCTOR’S NOTE TO BE EXCUSED FROM P.E. CLASS. Dress should be comfortable and appropriate for participating in active movement activities. (Students do not have time to change clothes prior to PE class.)
STUDENT RECOGNITION PROGRAM
The TOP Hat – This is a program to recognize positive behavior. One student per class is selected weekly.
Perfect Attendance – Students are recognized with a certificate at the end of the year and names will be sent to the Saluda Sentinel.
ILLNESS/ACCIDENTS AT SCHOOL: In the event of an accident, students will receive first aid for minor injuries. Every effort will be made to encourage students to remain at school when they complain of minor pains and discomfort. Parents must pick up their child if he/she is found to have a fever, becomes nauseated, or has other more serious illnesses or injuries. If a student has a condition that can be spread to others through contact, the parent will be notified, and the child must be taken home. A doctor should see rashes. The school must have evidence that the child is being treated. The child may return to school with a recommendation from a doctor or documentation from a pharmacist verifying the purchase of medicine.
EMERGENCY INFORMATION: Parents or guardians are responsible for keeping the school informed of all changes regarding telephone numbers, addresses, or medications the students may be taking. IN CASE OF AN EMERGENCY, IF NO ONE CAN BE NOTIFIED, THE DEPARTMENT OF SOCIAL SERVICES WILL BE NOTIFIED TO ASSIST THE SCHOOL IN RECEIVING PROPER SUPERVISION AND EMERGENCY CARE.
RULES FOR ADMINISTERING MEDICINES AT SCHOOL: Pupils are not allowed to bring medicines to school except as directed below.
· Prior to administering medication, a dated request, signed by the parent or guardian, must be presented to the school office. The medication form will include the child’s name, the name of the medication and the times of administration. Whenever possible, the expected duration of treatment shall be stated
· Each time a new or different medication must be administered at school, it must be accompanied by a request slip
· One permission slip per year shall suffice for medications which will be given on a long-term basis.
§ Medicine may be administered in case of exposure to allergens, for example, adrenaline for bee stings
· School personnel authorized to give such medications include the principal, secretary, teacher, guidance counselor or nurse
· Parents will be responsible to reclaim any unused medications within one week of the termination of treatment or within one week of the last day of school. Any unused prescription medications will be destroyed at this time

OFFICE REFERRALS: A student may be referred to the office for correction and intervention if the student is not responding to the classroom discipline plan or if the student exhibits behavior that is severe and/or continuously disruptive to the learning environment. The administrator will determine a course of action that, in his/her judgment is in the best interest of the student. The administration reserves the right to use discretion in any discipline case as deemed necessary; however, all students will receive fair and consistent consequences. Parents will be notified prior to a student suspension, provided the offense is not so serious as to warrant an automatic suspension. Courses of action may include but are not limited to:
A conference with the student Notify the parent Conference with the parent
Time out Lunch detention Recess detention
After-school detention Assignment or project Suspension
Self discipline contract Referral to guidance counselor
Referral to the Student Intervention Team In-school suspension

AFTER SCHOOL DETENTION: Students may be assigned after school detention as a consequence for misconduct. After-school detention will be held in the media center from 3:00p.m.until 4:00p.m. Assigned teachers will be on duty to monitor the students each week. The homeroom teachers are responsible for making sure your child has work to complete during this time period. If your child does not attempt to do his/her work or misbehaves during the detention period, he/she may be suspended from school. It is the responsibility of the parent to make sure that someone is at the school to pick up the child. You will be sent a form notifying you of your child’s detention assignment. BOARD POLICY
Weapons Offenses: The violations of laws prohibiting any person, except law enforcement officers or personnel authorized by school officials, to carry on his person, while on any elementary or secondary school property, a knife, with a blade over two inches long, a blackjack, a metal pipe or pole, firearms, or any other type of weapon, device or object which may be used to inflict bodily injury or death. This category also includes the carrying, in a concealed manner, a dirk, slingshot, metal knuckles, razor, or other deadly weapon usually used for the infliction of personal injury. This also includes any facsimile of such weapons. 59-63-280. Possession of paging devices by public school students under age eighteen prohibited.
A) For purpose of this section, “paging device” means a telecommunications device that emits an audible signal vibrates, displays a message, or otherwise summons or delivers a communication to the possessor.
B) A student under the age of eighteen in the public schools may not possess a paging device while on school property or while attending a school sponsored or school related activity on or off school property, unless the student needs the paging device for a legitimate medical reason. A student eighteen years of age and over in the public schools may not possess a paging device while on school property or while attending a school sponsored or school related activity on or fire fighting organization or a volunteer emergency medical service organization or unless the student needs the paging device for a legitimate medical reason. The principal of each school may decide what constitutes a legitimate medical reason consistent with any guideline as may be established by the school board of that district or by the State Departmento of Education. The principal of each school must secure and retain documented evidence of a student’s legitimate
medical need or his membership in a volunteer fire fighting or emergency medical service organization before that student may have a paging device at school if authorized by this section
C) A student who brings a “paging device” or a facsimile of a “paging device” will be subject to expulsion or probation, Saluda School District One Board Policy 4-14-93.
D) A person who discovers a student in possession of a paging device in violation of this section shall report the violation to the appropriate school administrator, as determined by school policy, who shall order a police officer or appropriate school employee to confiscate the device, which is forfeited to the school district.
Cell phone/paging device policy
Students may not have cellular telephones or paging devices in their possession in the school building. In addition, students may not have cellular telephones or paging devises on a bus (this includes both yellow buses and activity buses used for field trips). If a student is found with a cellular telephone or paging device in his/her possession, he/she will be subject to the consequences listed under level two of the discipline policy.
Harassment, Intimidation or Bullying Policy
The district board of trustees prohibits acts of harassment, intimidation or bullying. The district board of trustees has determined that a safe and civil environment in school is necessary for students to learn and achieve high academic standards; harassment, intimidation or bullying, like other disruptive or violent behaviors, is conduct that disrupts both a student’s ability to learn and a school’s ability to educate its students in a safe environment; and since students learn by example, school administrators, faculty, staff and volunteers should be commended for demonstrating appropriate behavior, treating others with civility and respect and refusing to tolerate harassment, intimidation or bullying.
Any person who feels he/she has been subjected to harassment, intimidation or bullying is encouraged to file a complaint in accordance with procedures established by the superintendent. Complaints will be investigated promptly, thoroughly and confidentially. All school employees are required to report alleged violations of this policy to the principal or his/her designee. Reports by students or employees may be made anonymously.
CODE OF CONDUCT
(Pre-K through Grade Five)
Consequences
The consequences listed for each level of offense in this document represent general guidelines. The administration reserves the right to apply any consequence to any level of infraction based on the discretion of the administrator and the circumstances surrounding the incident.
In-school suspension
One of the consequences used by the district, in-school suspension (ISS), allows students to remain on campus and complete assigned work in a controlled environment rather than being suspended out of school. Students are required to have assignments from their teachers and documentation from a parent/legal guardian acknowledging the date of ISS before participating in in-school suspension. Since consequences are intended to change inappropriate behavior, students are limited to eight days of in-school suspension per year. After the limit of in-school suspension days is exceeded, out of school suspension will be applied in all cases.
Out of school suspension
Another consequence is out of school suspension. When a student is suspended out of school, he/she may not come on campus during the time of his/her suspension. This includes extracurricular activities and athletic events. Students found on campus or at any school event while under suspension may be charged with trespassing. Work will not be provided for students while they are suspended; however, they have twice the number of days they were out to complete any missed work once they return to school. For example, if a student is suspended for two days, he/she has four days to make up missed work beginning with the first day of his/her return. Since consequences are intended to change inappropriate behavior, students are limited to 10 days of out of school suspension per year. After a student exceeds the limit of out of school suspension days, he/she may be assigned to the alternative school or referred to the hearing officer for possible expulsion.

Extenuating, mitigating or aggravating circumstances
The board may give the appropriate administrator the authority to consider extenuating, mitigating or aggravating circumstances which may exist in a particular case of misconduct. The administrator should consider such circumstances in determining the most appropriate sanction.
Discipline of disabled students
Disciplinary process
Disabled students are not exempt from school disciplinary processes, nor are they entitled to remain in a particular educational program when their conduct substantially impairs the education of other children in the program. However, federal and state laws and regulations require the public schools to meet the individual educational needs of disabled children to the extent that current educational expertise permits.
Program prescriptions
A disabled student's staffing committee may prescribe or prohibit specified disciplinary measures for an individual student by including appropriate provisions in the student's Individual Education Plan (IEP). The committee must take into consideration the student's disabling condition when deciding whether or not staff may use a particular form of discipline. Administrative authorities should observe any such provisions contained in a disabled student's individual education plan, except that a staffing committee may not prohibit the initiation of proceedings for suspension or expulsion which are conducted in accordance with regulation.
Suspensions
The administration may suspend a disabled student unless a suspension is prohibited by the student's individual education plan. At the end of the suspension, the school should return the student to the same educational placement, if appropriate. The school may suspend students for up to 10 days for a minor disciplinary infraction but for not more than 30 days in any one school year. (we deleted the sentence in blue and added the one in red) Since consequences are intended to change inappropriate behavior, students are limited to 10 days of out of school suspension. After a student exceeds the limit of out of school suspension days, he/she may be referred to the hearing officer for possible expulsion or home based instruction.
However, students who bring weapons to school or a school function or knowingly possess or use illegal drugs or solicit the sale of controlled substances or have inflicted serious bodily injury upon another person while at school or a school function may be removed for up to 45 days at a time. If school officials believe that a child with a disability is substantially likely to injure self or others in the child's regular placement, they may ask an impartial hearing officer to order that the child be removed to an interim alternative educational setting for a period up to 45 days.
Expulsions
Expulsion of a disabled student is equivalent to a change in educational placement and therefore requires special procedures. Before a disabled student may be expelled, a multi-disciplinary team must determine whether or not there is a connection or causal relationship between the disabling condition and the misconduct. If so, then expulsion resulting in cessation of educational services for the student would be unallowable.
The district will continue to provide a free and appropriate education as set forth in a student's IEP to expelled students with disabilities.
Immediate removal
Nothing contained in this administrative rule will be construed as limiting an administrator's ability to remove a disabled student from school immediately under emergency conditions.
